Governing Agreement for Travel Advisory Services — Required Reading & Acceptance at Intake
Michael Bain, doing business as Bain Travel Co., is sharing these terms & conditions to clarify how we work and ensure a smooth, transparent planning process for you.
These terms and conditions ("Agreement") govern the relationship between Michael Bain, an independent travel advisor ("Travel Advisor" or "we") on one side, and you, the purchaser of travel services or lead traveler ("Client" or "you"), on the other.
You represent and warrant that:
Travel Advisor is an independent travel advisor of Fora Travel, Inc. ("Fora") and operates its own separate travel business. Client understands and agrees that: (i) Travel Advisor is not an agent, representative or employee of Fora; (ii) Fora is a technology provider and host agency, not a travel service provider; (iii) Client will have no claim against Fora for losses or damages resulting from the provision of services by Travel Advisor; and (iv) Fora is not a party to this Agreement for any purpose.
Travel Advisor will provide Client with travel planning services, which may include researching and booking travel arrangements such as accommodations, transportation, activities and tours based on Client's preferences and budget. Travel Advisor may charge a guidance and design fee for its services, which will be mutually agreed in writing with Client. Any guidance and design fees charged are 100% non-refundable and due before Travel Advisor begins work on an itinerary.
The Travel Advisor's role is to make travel reservations for the Client upon request and to act as a liaison between the Client and travel suppliers. Client acknowledges that the suppliers whose names appear in travel documentation are actually responsible for providing the purchased travel services. Travel Advisor makes no guarantee regarding a supplier's rates, bookings, service quality, or special requests. Travel Advisor bears no responsibility for any changes, delays, alterations, modifications or cancellations of an itinerary or booking made by a supplier, other third party or due to force majeure.
Rates. All quoted prices are in USD unless otherwise indicated and are subject to change without notice. Prices cannot be guaranteed until the applicable service is booked and the deposit, if applicable, is received.
Currency Fluctuations. Client is aware that currency fluctuations may affect the final amount due.
Payment. Client will pay for all travel services promptly when due.
Credit Card Authorization. You may choose to keep a credit card on file with Travel Advisor. You agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions unless the product or services purchased were never provided or grossly misrepresented.
Nonrefundable Bookings. Client understands and agrees to all terms and conditions of suppliers from which it has purchased travel services. Client agrees to provide Travel Advisor with a minimum of 48 hours' notice by email for any cancellation or modification requests.
Travel Insurance. Travel insurance is not included unless expressly stated and purchased by Client. Without appropriate travel insurance, cancellation penalties will apply, resulting in potential loss of monies up to the full cost of Client's travel booking. Travel insurance is strongly recommended for all trips.
Passports. A passport is required for international travel, including for children and babies. For some countries, passports must be valid 6 months after the date of travel. A visa may be required by applicable government regulations.
Travel Advisories. Travel to certain destinations may involve greater risk. Changes to travel advisories shall not supersede the cancellation and refund policies of travel suppliers. Client's participation in any travel constitutes acceptance of such risk.
Travel Advisor acts solely as an authorized seller for disclosed travel suppliers and has no control over their operations. Travel Advisor is not liable for personal injury, property damage, or any issues arising from these suppliers' services. Travel Advisor disclaims all liability for direct, indirect, incidental, or consequential damages related to the goods or services provided by these suppliers. Any recovery from Travel Advisor will be limited to the amount of commission and fees actually received by Travel Advisor. The purchase of travel insurance is highly recommended on all trips.
Governing Law. The laws of the State of Arkansas govern this Agreement. You consent to the exclusive jurisdiction and venue of courts in Little Rock, Arkansas.
Claims. Any claim against Travel Advisor must be brought within 12 months after completion of the trip. You agree that you may only bring claims in your individual capacity and not as plaintiffs or class members in any class action.
Modifications. Travel Advisor reserves the right to amend this Agreement at any time. Updated versions are effective immediately upon provision to Client.
Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof.
By signing the Client Services Agreement provided at intake — including by typing your full legal name — you acknowledge that you have read, understood, and agree to be bound by this Agreement, on behalf of yourself and all travelers included in your booking.
